Order terms
Please read these order terms and conditions before providing payment for your order.
Diamond Sky Cakes accepts credit cards (preferred) and cash. Payment in full is due to reserve your order once details are confirmed.
LIABILITY
1. Please be advised that Diamond Sky Cakes LLC operates under the N.J.A.C. 8:24-11 Cottage Food Operator Rule and that foods are prepared in a home kitchen that has not been inspected by the Department of Health.
2. Diamond Sky Cakes LLC is not responsible for bodily injury, property or consequential damage, which may result from our services.
3. Diamond Sky Cakes LLC is not responsible for any damage to the baked goods or shortage of baked goods caused by anyone NOT employed by Diamond Sky Cakes LLC.
4. Diamond Sky Cakes LLC will not deliver a cake or other baked goods if payments have not been paid in full.
5. Diamond Sky Cakes LLC is not responsible for any delay or inability to deliver based on accidents, natural disasters, transportation issues, inclement weather, illness, death, labor troubles, delay in supplies, disputes or strikes, or any other circumstance beyond Diamond Sky Cakes LLC’s control.
6. If Client picks up the baked goods, Diamond Sky Cakes LLC no longer assumes any responsibility for any damage that occurs or is caused to it.
POSTPONEMENT, CANCELLATION AND CHANGES
1. The Client must notify Diamond Sky Cakes LLC if there is a change in the date of the event or a complete cancellation.
2. Large orders will be subject to fees for postponement within four (4) days of delivery or cancellation within seven (7) days of delivery. Any order changes must be submitted at least seven (7) days prior to delivery date. No changes will be allowed six (6) or fewer days prior to delivery.
3. Any changes to an order must be submitted at least seven (7) days prior to the event. No changes will be allowed six (6) or fewer days prior to the event.
CAKE, CUPCAKE AND COOKIE DESIGN
1. Diamond Sky Cakes LLC will follow the Client’s requests closely to create the desired cake or cookies. As decorating is done by hand, there may be small differences between inspiration images and the final result. We try to match colors as best as we can, however, cannot guarantee an exact color match.
2. Diamond Sky Cakes LLC cannot duplicate an exact copy of another cake artist’s work but will ensure the look is similar. Diamond Sky Cakes LLC cannot produce cakes that depict copyrighted characters or images.
ALLERGY & DIETARY WARNINGS
1. Diamond Sky Cakes LLC’s baked goods may have come in contact with the following ingredients: wheat, eggs, milk, natural dyes, artificial dyes, artificial flavorings, sugar, artificial sweeteners, artificial color and other allergens not listed.
2. The Client is responsible for informing guests about potential allergy hazards.
ORNAMENTS & SPECIAL EQUIPMENT
1. A 10% deposit is required for all rental equipment.
2. The equipment must be returned within 48 hours of the event.
3. The returned equipment is evaluated and a refund of the deposit is based on the condition of the items.
4. All personally supplied items must be submitted to Diamond Sky Cakes LLC at least seven (7) days prior to the event.
DELIVERY
1. The Client may pick up the baked goods at no cost. The Client assumes liability once the baked goods pass into the Client’s possession.
2. The Client is responsible for providing a suitable environment for the cake or other baked goods (away from heaters, vibrations, people, suitable surface, and a suitable outdoor setting).
PHOTOGRAPHS AND SOCIAL MEDIA
Diamond Sky Cakes LLC reserves the right to use all photographs of the cake for advertising purposes and for publication on social media and websites.
